ANNULMENT

Orange County Annulment

An annulment is when a court decides that for some reason your marriage is not legally valid. This situation is rare in California but not completely unheard of. Annulments can occur in cases of incest or bigamy (when someone who is already legally married goes through a second marriage).

Legal causes/grounds for annulments in California

  •  One (or both) spouses were forced into the marriage
  • The partners are too closely related (see explanation below)
  • Either of the partners had a physical or mental incapacity to enter the marriage legally
  • One of the partners was already married (bigamy)
  • The marriage was deemed to be based upon fraud
  • Either partner was under California's legal age for marriage (18)

Legal incest is defined by California Family Code 2200 which states:

Marriages between parents and children, ancestors and descendants of every degree, and between siblings of the half as well as the whole blood, and between uncles or aunts and nieces or nephews, are incestuous, and void from the beginning, whether the relationship is legitimate or illegitimate.

Nullity Hearings

Due to the infrequency which nullity cases occur, they all go straight to court for hearing before a judge.
